Continuance A court order postponing proceedings. Assault A willful attempt to illegally inflict injury on or threaten a person. False pretenses Representation of some fact or circumstance which is not true and is calculated to mislead, whereby a person obtains another's money or goods Preponderance of evidence Evidence that is (even minimally) of greater weight or more convincing than the evidence, which is offered in opposition to it. This is the standard by which a plaintiff must prove his/her case in a civil suit. Parole A procedure in which a parole board releases a convict on good behavior before the maximum sentence expires. Adversary system The system of trial practice in the United States and some other countries in which each of the opposing, or adversary, parties has the opportunity to present and establish opposing contentions before the court Original jurisdiction The court in which a matter must first be filed. Discovery The process through which parties to an action are allowed to obtain relevant information known to other parties or nonparties before trial
